Sweepstakes Terms and Conditions:

NO PURCHASE NECESSARY TO ENTER OR WIN THIS ONLINE SWEEPSTAKES. VOID WHERE PROHIBITED BY LAW. PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

Sweepstakes may only be entered in or from the 50 United States and the District of Columbia. Any entries originating from any other jurisdiction are not eligible for entry and will be voided. This Sweepstakes is governed exclusively by the laws of the United States. You are not authorized to participate in the Sweepstakes if you are not located within the 50 United States or the District of Columbia.

 

1. Eligibility: All legal U.S. citizens who are at least 18 years of age at the time of entry, have a valid driver’s license, and can provide a social security number may participate in this contest. The contestant must be a legal resident of one of the 50 United States or the District of Colombia for the duration of the contest and must enter from one of the 50 United States or the District of Columbia. Prize Winner is subject to proving eligibility, including verification of a valid driver’s license and social security number. Employees, officers and representatives of Danforth Diamond and its website www.danforthdiamond.com (collectively referred to as the “Sponsors” or “Sponsor”) their affiliates, their immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to participate.

 

2. Timing:  The Sweepstakes will be posted on www.danforthdiamond.com starting around March 8, 2011 and ending at 11:59 P.M. (EST) on April 25, 2011 (“Promo Period”).

 

3. How to Enter: Visit www.danforthdiamond.com and follow the links for Sweepstake entry. Proceed to fully complete and transmit the on-line entry form before 11:59 P.M. (EST) on April 25, 2011. Participants must fill out completely the required fields on the Sweepstakes entry form to be entered into the random drawing. Incomplete or inaccurate entry forms will be considered ineligible and void. All online entries must be received during the Promotion Period. Limit one entry per person during the Promotion Period.  If any entrant uses multiple email addresses to submit more than one online entry, only the first online entry will be accepted. In the event of a dispute as to any online entry, the authorized account holder and/or user of the email address used to enter will be deemed to be the entrant (“Entrant”). The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Entrants may be required to show proof of being the authorized account holder.
   

 

4. Description of Prize: 14K White Gold Diamond Heart pendant with 18 inch cable chain. 80 brilliant H-I color, I1 clarity diamonds give this pendant lots of sparkle. The beautiful heart is suspended on an 18 inch white gold cable chain. The necklace is fastened with our very secure safety clasp to help protect you against loss.

 

5. Drawing: The Prize Winner will be chosen at random by Jill Renee, President of DanforthDiamond.com from among all of the Eligible Entries received.

 

6. Agreement to Official Rules: The Prize Winner must sign an approved claim form, which shall include an affidavit of eligibility and release of Sponsors and their affiliates from any and all liability, claims, demands, and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this promotion or the use or acceptance of the Prize package or any portion thereof to claim the Prize. This affidavit along with a Liability Release and where lawful, a Publicity Release must be received within 20 days of prize notification. The Sweepstakes winner will receive an e-mail and up to two telephone calls from Danforth Diamond at the e-mail and phone number(s) provided in the entry form. If the winner cannot be contacted within 10 calendar days of first notification attempt, if prize or prize notification is returned as undeliverable, if winner rejects his/her prize or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and by the decisions of Sponsors, which are final in all matters relating to this Sweepstakes.
   

 

7. General Conditions: VOID WHERE PROHIBITED BY LAW.  All interpretations and decisions under these Official Rules by Sponsors are final and binding. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or the www.danforthdiamond.com website; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE VIRGINIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY OF THE CONTROVERSY REGARDING THE SWEEPSTAKES, AND THE LAWS OF THE STATE OF VIRGINIA SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
   
   Proof of submission will not be deemed to be proof of receipt by Sponsor. If, for any reason, the sweepstakes is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, force majeure technical failures, or any other causes which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the sweepstakes and select the winner for the sweepstakes from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Sponsor. Sponsor reserves the right to modify the scheduling of the sweepstakes without prior notification.

 

8. Publicity Release.  By entering, entrants grant Sponsor permission to send Sponsor-related commercial emails to the address used to enter. Sponsor will have the right to photograph winner. Entry constitutes permission to winner’s name, picture, likeness, and city and state of residence for purposes of trade, publicity or promotion for no additional compensation except where prohibited by law.  If selected as the Prize Winner, Entrant agrees to sign a Publicity Release, except where prohibited by law.

 

9. Liability: Sponsors are not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes or for any reason Sponsors deem it necessary, Sponsors reserve the right in their sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsors will post notice on www.danforthdiamond.com and conduct a random drawing from among all Eligible Entries received as of the date of termination to determine the Grand Prize Winner. Entries that have been tampered with or altered are void.

 

10. Winners List: A statement of the name of the winner will be available after May 13, 2011. To obtain this information, send a self-addressed stamped envelope to: Danforth Diamond Sweepstakes, 14241 Midlothian Turnpike, Suite 183, Midlothian, VA 23113-6500. All requests must be received by June 15, 2011.

 

11. Release: BY ENTERING THIS SWEEPSTAKES, ENTRANT AGREES TO RELEASE AND HOLD HARMLESS DANFORTH DIAMOND AND EACH OF THEIR RELATED AND AFFILIATED COMPANIES, RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE SWEEPSTAKES OR RECEIPT OR USE OF ANY PRIZE IN ANY RESPECT.

 

12. Sponsors: This sweepstakes is sponsored by Danforth Diamond, a Virginia corporation.

 

13. Entrant’s Personal Information: Information collected from an Entrant is subject to the Privacy Policy of Danforth Diamond. Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy by visiting http://www.danforthdiamond.com/privacy-policy/.  By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.

 

14. Odds of Winning: The actual number of valid entries received will determine odds of winning.

 

15. Shipment: The prize can only be shipped to a location within the U.S.
